GSA FAS temporarily allows the award of non-TAA compliant products under MAS program to respond to the COVID-19 pandemic for limited Federal Supply Classes (FSCs)

President Trump declared a National Emergency Concerning the COVID-19 Outbreak on March 13, 2020. 

Due to the COVID-19 pandemic, demand for certain critical and essential supply items has increased to the point that many Multiple Award Schedule (MAS) contractors are unable to meet Federal demands with Trade Agreements Act (TAA) compliant products. To address this, the GSA Senior Procurement Executive (SPE) has issued a memorandum citing non-availability as the basis for temporarily allowing the procurement of non-TAA compliant products under FSS MAS contracts for certain Federal Supply Classes (FSCs). FSCs are Product Service Codes (PSCs) that define a category of products or services that the government purchases.

This exception is limited to the FSCs found in Attachment 1 of SPE Memo 2020-11, which are subject to change including:

  • N95 Masks

  • Sodium Hypochlorite (bleach)

  • Disinfectants includes cleaners, sprays and wipes

  • Cleaners including sanitizing surface and floor cleaners

  • Hand Sanitizers, soaps and dispensers

If you have access to products under these FSCs and can meet the government’s urgent need, submit a modification request via the eMod system proposing to add non-TAA compliant products to your FSS contract following the Instructions for FSS Contracts to add Non-TAA Compliant Products to your Schedule Contract.
