GSA Issues Mass Modification A344 to Remove Clause I-FSS-125
GSA issued FAS Instructional Letter IL 2013-06 to reiterate their interpretation of cancelled clause I-FSS-125 dated September 1999 and delete any remaining I-FSS-125 clauses and similar language, from existing Federal Supply Schedule (FSS) contracts.
Background
The GSA Office of Inspector General (OIG) has conducted an audit that identifies a small pool of vendors who have cited cancelled clause I-FSS-125 as the basis for not providing price reductions for sales over the Maximum Order Threshold (MOT). This occurred because these vendors claim the language of GSA contract clause I-FSS-125 exempts schedule orders over the maximum order from the Price Reductions clause (PRC).
Applicability
The IL applies to all GSA/FAS acquisition activities awarding and administering FSS contracts.
Recommended Action
Mass Modification A344 is mandatory and applicable to ALL GSA Schedule contracts. Although Clause I-FSS-125 was canceled in 2004, the clause language still remains in some FSS contracts. You must go to the Vendor Support Center to accept Mass Modification A344 before January 31, 2014 to keep your contract compliant. This can be accomplished by going directly to the GSA Vendor Support Center. If you have questions on how to navigate the Vendor Support Center to accept Mass Mod A344 you may contact BH Sky Associates by either phone (866.468.7420) or email.
